Justice Anthony Kennedy is expected to be the swing vote in the pivotal WholeWoman’s Health v. Hellerstedt—a case that could leave the entire state of Texas with just ten abortion clinics.

Today, Justice Kennedy suggested that a lower court might need to gather more information before the Court gives a ruling. In the meanwhile, abortion rights advocates are hoping he’ll ultimately join the court’s four liberal justices in deeming the regulations unconstitutional. But the Texas law will stand if the court splits four to four but the decision won’t set a precedent for the rest of the country.
